The Complaint contains numerous examples of false health claims made by MonaVie and its distributors. For example, the Complaint includes transcripts of MonaVie meetings with speeches by "doctors" who falsely claim that MonaVie can cure cancer, stop aging at a rapid pace, improve vision, and eliminate pain. The "doctors" describe "dosages" of MonaVie to falsely imply that it is a medicine.

In addition, MonaVie distributors have attempted to raid Quixtar IBO organizations using these false claims.

The Complaint explains that while MonaVie has only been around only a few years, its founder was associated with a now defunct company which enjoyed tremendous growth by marketing a "superfood" derived from a sea plant. A month away from his trip to federal prison, Neways founder Thomas E. Mower Sr. is opening a new manufacturing plant for personal care products and dietary supplements in Springville and plans to hire up to 150 workers by year-end.

Mower, who will start serving a 33-month prison sentence on Nov.

13 for income tax evasion, bought the former corporate headquarters of Little Giant Ladder in Springville for nearly $3.5 million on Friday -- as part of his plans for his new company, SupraNaturals LLC.

Incorporated in 2004, SupraNaturals's corporate headquarters and manufacturing plant will occupy a 332,000-square-foot building at 1356 W. Spring Creek Place in Springville. It is scheduled to open in November. The Little Giant Ladder office --a 96,000-square-foot building at 1325 W. Industrial Circle that is still occupied by Wing Enterprises, will be converted into additional manufacturing and office space for SupraNaturals once Wing's lease expires in April 2007, said Ryan Moss, Wing's CEO. The ladder maker is relocating to a nearby 240,000-square-foot building at 1198 N. Spring Creek Place, which was formerly occupied by local health food manufacturer E. Excel International Inc.

SupraNaturals's plant

When completed in mid-2007, the SupraNaturals plant will be a private label maker of personal care products including shampoos, conditioners and soap, as well as dietary supplements, bottled water and chewing gum.

"We have contracts with liquid soap customers, and hope eventually to also make dietary supplement capsules. But we won't have any specific brand or formulas under the SupraNaturals's name," said Gary Chlarson, who has served as project manager with the company for past 18 months.

"We acquired the Little Giant Ladder building because of its proximity to our building, which gives us the room to expand," he said.

SPRINGVILLE, Utah, Jun 12, 2007 (BUSINESS WIRE) -- A United States Federal Judge has issued an injunction against Neways' former owner, Thomas Mower Sr.; his two sons, Thomas Mower Jr. and Darick Mower; and their new companies, Sisel International, LLC and SupraNaturals, LLC.

Following a hearing on May 25, 2007, United States District Judge Bruce S. Jenkins enjoined the Mowers and their new companies from using any Neways product formulas, distributor lists, or vendor lists. The court further ordered the Mowers and their companies to return to Neways any computer disks containing such information.

In a complaint filed May 23, 2007, in the United States District Court for the District of Utah, Neways International alleges that, after selling Neways to Golden Gate Capital for hundreds of millions of dollars and before Thomas Mower Sr. began serving his prison sentence for tax evasion, Mr. Mower, in conspiracy with his two sons, misappropriated many of Neways' trade secrets, including distributor lists, vendor lists, and product formulas, in an effort to start a competing network marketing business.

After Neways presented substantial evidence in support of that claim, the court issued the injunction enjoining the Mowers and their new companies from using any Neways distributor lists or any other confidential and proprietary information contained on computer disks taken from Neways.

In taking this legal action, Neways reinforces the company's unalterable commitment to its hard-working distributors and employees and to fair and appropriate business practices. As Neways argued in its papers, Sisel "can compete, but they can't cheat."

The court has set the matter for a further hearing to take additional evidence in the case.

SALT LAKE CITY--(Business Wire)-- A federal court in Utah has issued an injunction against Sisel International, LLC and five of Sisel's top distributors in Japan. Among other things, the injunction requires Sisel and these distributors to return all of Neways' distributor information in their possession and prohibits Sisel and its distributors from using such information. In addition, the Court found that Sisel's top three distributors--Koji Yamamoto, Fumiko Matsumoto and Toru Egashira--likely have breached their contracts with Neways by recruiting Neways distributors to join Sisel, and are now prohibited from continuing to recruit Neways distributors for a period of one year from each distributor's date of suspension from Neways.

In its 23-page ruling issued February 11, 2008, the Court ordered Sisel, Mr. Yamamoto, Ms. Matsumoto, Mr. Egashira, Kaoru Kitagawa, and Chiharu Hayashi to thoroughly search for and return all information relating to Neways' distributors and prohibited them from using such information in the future.

The victory was a significant one for Neways, and came after a two-week evidentiary hearing in federal court. Neways alleged that Sisel and its Japanese distributors were misappropriating Neways' confidential and trade secret information regarding Neways' distributor network, and that the Japanese distributors were breaching their contracts with Neways by soliciting Neways distributors to join Sisel. After hearing all of the evidence, including testimony by the Japanese distributors themselves, the Court found that Neways was likely to prevail on these claims and that the defendants should be enjoined.

This is the third time in less than a year that Neways has prevailed against Sisel or one of Sisel's distributors. In May 2007, the same federal court ordered Sisel, its owner Thomas Mower, Sr., and several of its employees to return all copies of Neways' product formulas, vendor lists, and distributor lists, and prohibited them from continuing to use that information. Two months later, a Utah state court entered an order against Sisel distributors Jef and Patricia Welch restraining them from recruiting any present Neways distributor to participate in another multi-level marketing company. As a result of the federal court's recent ruling, a similar restraint is now in place against Mr. Yamomoto, Ms. Matsumoto, and Mr. Egashira.

"Neways is extremely pleased with the Court's ruling," said Eric Larsen, Neways' C.E.O. "In enjoining Sisel and its top Japanese distributors, the Court has affirmed what Neways has always believed--that companies are free to compete in this market, but they must do so fairly and honestly. "Two courts have now recognized the importance of those protections," said Crump, "and Neways will continue to take all necessary steps to ensure that our distributors' businesses are protected."

The case will now proceed on Neways' other claims against Sisel, Mr. Mower, and the other defendants. These claims include allegations that Mr. Mower breached his fiduciary duties to Neways, that Sisel's products are the result of unlawful theft by Sisel of Neways' trade secrets, and that Mr. Mower and a number of other Sisel employees have intentionally destroyed evidence to prevent it from being discovered in the case.

The 10th U.S. Circuit Court of Appeals today upheld the tax evasion and tax fraud convictions of the founders of Neways Inc., a Springville multilevel marketing company, and its former corporate counsel. The Denver-based court rejected the appeals of the three - Thomas E. Mower; currently the Founder and Chairman of a new network marketing company, SISEL International, his ex-wife, Leslie DeeAnn Mower; and James Louis Thompson, a now-disbarred Orem attorney - who claimed they were convicted by a jury on insufficient evidence. At a 2005 trial, federal prosecutors alleged that the three concealed more than $1 million in receipts received from Neways Australia and more than $3 million in commission income the Mowers received from U.S., Australian and Malaysian distributorships. Neways manufactures, markets and sells personal care and nutritional products in the United States and about two dozen foreign countries. The jury convicted each of the Mowers of one count of conspiracy to defraud the United States and six counts of tax evasion. Thompson was convicted of one count each of conspiracy and of corruptly impeding the due administration of tax laws. Thomas Mower was sentenced to 33 months in prison, while his former wife was ordered to spend 27 months behind bars. The two also were ordered to pay back taxes. Thompson, who served as counsel for Neways from 1995 to 1997, was sentenced to a year and a day in prison. The Mowers sold Neways in 2006 to Golden Gate Capital, a Francisco-based company that had invested heavily in Herbalife.
